Terms of Service

1. Acceptance of Terms

By accessing or using RareRoam (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. These Terms apply to all visitors, registered users, contributors, and any other person who accesses or uses the Platform.

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you confirm that you have parental or guardian consent. By creating an account or uploading content, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. User Accounts

You may browse and download photos without creating an account. To upload photos and participate as a contributor, you must register an account using a valid email address or Google sign-in.

• You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
• You must not share your account with others or allow others to access your account.
• Notify us immediately at support@RareRoam.com if you suspect unauthorised access to your account.
• You may delete your account at any time from the Settings page. Deletion permanently removes your profile and uploaded photos.

4. Contributor Program

4.1 Becoming a Contributor

To upload photos you must apply for contributor status. Applications are reviewed and approved by our team. Approval is at our sole discretion, and we may decline or revoke contributor status at any time without liability.

4.2 Content Standards

Every photo you submit must:

• Be an original photograph taken by you personally.
• Not be copied, screenshotted, or re-uploaded from any other website, platform, or stock library.
• Not be generated or substantially altered by artificial intelligence tools.
• Not infringe any third-party copyright, trademark, privacy right, or other legal right.
• Comply with all applicable laws and our Community Guidelines.

If your photo includes identifiable people, private property, or trademarked elements, you are solely responsible for obtaining all necessary model releases, property releases, and permissions before uploading. RareRoam does not verify releases and accepts no liability for content uploaded without proper authorisation.

4.3 License Grant from Contributors

By uploading a photo to RareRoam, you grant RareRoam a non-exclusive, worldwide, royalty-free, irrevocable licence to host, store, reproduce, display, distribute, and sublicense your photo to users of the Platform under the RareRoam Photo Licence described in Section 5. You retain ownership of your photos and may continue to use them elsewhere.

You represent and warrant that you own or control all necessary rights to grant this licence, and that your photos do not violate any applicable law or third-party rights.

4.4 Content Review

All submitted photos are reviewed by our team before publication. We may reject, remove, or unpublish any photo at any time without notice or explanation.

5. The RareRoam Photo Licence

Photos available on RareRoam are provided under the RareRoam Photo Licence. By downloading a photo, you agree to the terms of this licence. For full details see our Copyright & Licence Policy.

5.1 What You May Do

• Download and use photos for personal, editorial, or commercial purposes (e.g., blog posts, articles, designs, social media, marketing materials, printed products).
• Modify, crop, resize, or adapt photos for your own projects.

5.2 What You May Not Do

• Sell or redistribute photos as standalone image files or as part of a competing stock photo library, collection, or download service.
• Claim authorship or original ownership of the photos.
• Upload RareRoam photos to any competing stock photo platform or image-sharing service for redistribution.
• Use photos in a way that is defamatory, harassing, obscene, or illegal.
• Use photos to misrepresent a person's identity, statements, or affiliations.
• Mint, tokenise, or list photos as NFTs or digital assets for sale without written consent from the contributor.

Attribution is appreciated but not required. Where attribution is provided, please credit the photographer and link to their RareRoam profile where practical.

6. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Scrape, crawl, or systematically download content without prior written permission from RareRoam.
• Interfere with or disrupt the Platform, servers, or networks connected to the Platform.
• Upload malicious code, viruses, or any software designed to damage or alter the Platform.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Harass, threaten, or abuse other users.
• Post spam, solicitations, or unsolicited commercial communications.
• Attempt to circumvent any content filtering, security, or access controls on the Platform.

7. Reporting Content

If you believe that any content on RareRoam violates these Terms, infringes your copyright, or is otherwise unlawful, please report it using the report function on the photo detail page or contact us at support@RareRoam.com. 8. Intellectual Property of RareRoam

The RareRoam name, logo, design, and all Platform software, features, and functionality are owned by RareRoam and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, or create derivative works of any RareRoam-owned content without our express written permission.

These Terms do not grant you any rights to the RareRoam brand, trademarks, or proprietary technology.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimer of Warranties

The Platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

RareRoam does not warrant that photos on the Platform are free from third-party intellectual property claims, that any content is accurate or suitable for your intended use, or that the Platform will be error-free or continuously available.

You download and use photos at your own risk and are solely responsible for verifying that your use complies with applicable laws and the rights of third parties.

11. Limitation of Liability

To the fullest extent permitted by applicable law, RareRoam and its operators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or any content downloaded from it, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or related to these Terms or the Platform shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.

RareRoam is not responsible for any harm resulting from your reliance on content uploaded by third-party contributors.

12. Indemnification

You agree to indemnify, defend, and hold harmless RareRoam and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform or any downloaded content.
• Any photos you upload, including claims that your photos infringe third-party rights.
• Your violation of these Terms or any applicable law.
• Any misrepresentation you make in connection with your account or content.

13. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your licence to use the Platform ceases immediately. Sections 4.3, 5, 10, 11, 12, and 14 survive termination.

Photos that were downloaded by other users prior to termination remain under the RareRoam Photo Licence granted at the time of download.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which RareRoam is operated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform shall first be attempted to be resolved amicably. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

15. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy and Copyright & Licence Policy, constitute the entire agreement between you and RareRoam.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No waiver: Failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely.
