Copyright & Licence Policy

1. Content Ownership

Every photo on RareRoam is taken by and remains the property of the individual contributor who uploaded it. RareRoam does not own any user-submitted photos. Contributors retain full copyright in their work.

By uploading a photo, contributors grant RareRoam and the public a licence to use that photo under the terms described below.

2. Licence Granted by Contributors

When a contributor uploads a photo to RareRoam, they grant RareRoam a non-exclusive, worldwide, royalty-free, irrevocable licence to:

  • Host, store, and display the photo on the Platform.
  • Create and display thumbnail and preview versions.
  • Distribute and sublicense the photo to users under the RareRoam Photo Licence below.
  • Use the photo for promotional purposes related to RareRoam (e.g., featured photos, social media).

Contributors continue to own their photos and may use, licence, or sell them elsewhere. This licence does not prevent contributors from doing so.

3. The RareRoam Photo Licence

When you download a photo from RareRoam, you receive a non-exclusive, worldwide, royalty-free licence to use the photo subject to the terms below.

3.1 Permitted Uses

You may:

  • Use photos for personal projects (prints, mood boards, gifts, wallpapers).
  • Use photos for commercial purposes (websites, blog posts, social media, advertising, marketing materials, printed merchandise, presentations).
  • Use photos for editorial purposes (news articles, reviews, educational content).
  • Crop, resize, filter, composite, or otherwise adapt photos for your project.

3.2 Restrictions — You May Not

  • Sell or redistribute photos as standalone files — you cannot sell, license, or give away RareRoam photos as image files, whether individually or as part of a collection or bundle.
  • Use on competing platforms — you cannot upload RareRoam photos to any stock photo website, free image-download service, or photo-sharing marketplace for redistribution.
  • Claim ownership — you cannot represent that you are the original creator or copyright owner of a RareRoam photo.
  • Defamatory or illegal use — you cannot use photos in a way that is defamatory, misleading, harassing, obscene, or that violates any law.
  • Misrepresentation of people — you cannot use photos featuring identifiable people to falsely imply endorsement, affiliation, or to misrepresent their views or identity.
  • NFTs and digital assets — you cannot mint, tokenise, or list photos (or modified versions) as NFTs or other digital assets for sale without the written consent of the original contributor.

3.3 Attribution

Attribution is appreciated but not required. When you do attribute, crediting the photographer by name and linking to their RareRoam profile is the preferred format.

This licence does not grant you any trade mark rights in the RareRoam name or brand.

3.4 No Warranty

Photos are provided as-is. RareRoam does not warrant that any photo is free from third-party intellectual property claims, that it includes the necessary model or property releases for your specific intended use, or that it is suitable for any particular purpose. You are responsible for assessing whether a photo is appropriate for your use and for obtaining any additional permissions that may be required.

4. Copyright Infringement — DMCA Takedown Process

RareRoam respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on RareRoam infringes your copyright, you may submit a takedown notice to our designated contact below.

RareRoam also honours valid takedown notices from rights holders outside the United States on equivalent grounds.

4.1 How to File a Takedown Notice

Send your notice to dmca@RareRoam.com with the subject line "DMCA Takedown Notice". Your notice must include all of the following:

  1. Your signature — a physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work — a description of the copyrighted work you claim has been infringed. If multiple works are covered, a representative list.
  3. Identification of the infringing material — the URL(s) of the photo(s) on RareRoam that you claim are infringing, with enough detail for us to locate them.
  4. Your contact information — your name, mailing address, telephone number, and email address.
  5. Good faith statement — a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. Accuracy statement — a statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner.

Upon receiving a complete and valid notice, we will promptly remove or disable access to the identified content and notify the contributor.

4.2 Counter-Notification

If your photo was removed in response to a DMCA notice and you believe the removal was made in error, you may submit a counter-notification to dmca@RareRoam.com. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the US, any judicial district in which RareRoam may be found), and that you will accept service of process from the party who submitted the original notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed content.

5. Repeat Infringer Policy

RareRoam has a zero-tolerance policy for repeat copyright infringement. Contributor accounts that are the subject of multiple valid DMCA takedown notices will be suspended or permanently terminated at our discretion, in accordance with our policy under 17 U.S.C. § 512(i).

6. Abuse of the DMCA Process

Submitting a false or materially misleading DMCA notice or counter-notification may result in civil liability under 17 U.S.C. § 512(f) and other applicable laws. We reserve the right to seek damages and legal costs from parties who abuse the takedown process.

7. RareRoam Platform Content

The RareRoam name, logo, website design, and all software and original content produced by RareRoam are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works of RareRoam's own content without prior written permission.
